Terms & Conditions

Welcome to Aerenica!

This document explains how you can use the Website, its Content, and how the submission and acceptance of purchase orders for Products offered by the Seller through the Website are governed. Read it carefully and keep a copy!

Use of the Web Site and any submission of a purchase order implies full knowledge and express acceptance of the Terms & Conditions that are described herein. If after reading them you do not intend to accept them, please stop browsing.

ART. 1- DEFINITIONS

The words with capital letters listed below, both singular and plural, shall be construed with the meanings hereinafter assigned to them in this section:

Aerenica or Seller: AERENICA s.r.l. (VAT no. 12956290014), with registered office in Corso Massimo D’Azeglio 60/H, Torino (TO) - Italy, certified e-mail address: aerenicasrl@pec.cgn.it , e-mail address: support@aerenica.com that manages the Website, and the first, second and third level domains, as well as is the owner of them, the Contents and the services provided through them; is the manager and/or owner of the infrastructure, IT and otherwise, supporting them;

Website: the website www.aerenica.com and all domains referred to by the website operated by Aerenica, which provides an information society service consisting of, among others, offering Users the opportunity to purchase Products and enjoy Contents;

User: the natural person who uses the Website;

Registered User: the natural person who has registered his/her data on the Website and has at his/her disposal, under license, his/her own Profile;

Customer: both the Registered User and the unregistered User identified through the data entered in the Order Proposal who acts as a Consumer by purchasing Products through the Website;

Profile: the restricted area uniquely traceable to a Registered User consisting of a digital environment with customizable content and functionality, isolated from other Profiles and licensed together with a unique password and username, chosen by and assigned to the Registered User;

Content: all the materials on the Website, none excluded, owned by Aerenica S.r.l. or its licensors (by way of example but not limited to, text, images, photographs, documents, video materials, logos, designs, models, original or reproduced generation works, including software, site operation logics, menus, layouts, graphics and colors, etc.), even if they do not qualify as creative works of the intellect;

Consumer Code: Italian Legislative Decree no. 206/2005;

Order Confirmation: the e-mail that the Seller will send to the Customer upon purchase of the Products confirming receipt of the Order;

Delivery: the delivery of the Products to the address indicated in the Order Confirmation;

Consumer: the natural person who is acting for purposes which are not related to his/her trade, business or profession, pursuant to Article 3, paragraph 1, letter a) of the Consumer Code;

Contract: the agreement entered into between the Seller and the Customer for the purchase and sale of Products through the Website that consists of the Order Confirmation and theseTerms&Conditions;

Order: an order for Products placed through the Website and concluded after payment;

Products: the products made available by Seller upon purchase on the Website;

Bespoke Products: the Products custom-made by the Seller according to the Customer's requirements;

Ready-to-Wear Products: the Products sold on the Website in standardized sizes;

Terms&Conditions or T&Cs: these terms and conditions of use and sale.

 

ART. 2- APPLICABILITY

These T&Cs apply to User's entire use of the Website, as well as to all Contracts for the sale of Products entered into between Seller and Customer on the Website.

These T&Cs are made available in the footer of the Website by appropriate link so that they may be stored and reproduced by the User.

At the signature of the Contract, the Customer therefore declares that it has read and fully accepts these T&Cs, which form an integral part of the Contract.

These T&Cs shall remain effective until expressly updated and/or supplemented and/or superseded or otherwise amended by Seller by means of a written document. Such amendments may be made by Seller at any time by giving notice thereof on the Website. Therefore, the amended T&Cs shall be effective as of the date of publication on the Website and shall apply as of such date without any obligation on the part of Seller to give notice thereof other than on the Website.

These T&Cs govern the purchase of Products on the Website and do not, however, govern the sale of products or services by parties other than Seller that are featured on the Website through links, banners, or other hyperlinks. The Seller is not responsible for the provision of goods and services by third parties.

The Product offerings on the Website are intended for Customers of legal age. By placing an order through the Website, the Customer warrants that he or she is over 18 years of age and has the legal capacity to enter into binding contracts.

The purchase of Products on the Website to which these T&Cs apply is for Consumers only.

 

ART. 3- WEB SITE’S USE

Users may use the Website freely and at their sole and exclusive responsibility.

The User may not use the Website:

- if he or she doesn’t have the capacity to act and validly obligate himself or herself under the applicable laws to which he or she is subject;

- if Aerenica has disabled the Profile due to violation of these T&Cs or disputes that have arisen with the same.

Aerenica reserves the right to prosecute any breach, direct or indirect, of these T&Cs.

Aerenica informs the User that the Website Contents may contain errors or inaccuracies.

 

ART. 4- USER'S OBLIGATIONS AND RESPONSIBILITIES

By using the Website, the User agrees to:

- comply with these T&Cs;

- not to use the Website and its subdomains for illegal, deceptive, discriminatory defamatory purposes or unlawful activities;

- not provide false and/or third-party personal information;

- not attempt to tamper with the Website in any part, damage it, or impair its operation;

- not probe, examine or test any vulnerability of the Website or any network connected to it, as well as breach its security or authentication measures;

- not to attempt to upload data, information or software containing viruses or other harmful or damaging code, in violation of the law, including the law on the protection of intellectual property, Aerenica or the rights of third parties;

- not use the Website for purposes that are unlawful or other than what these T&Cs provide;

- not exploit the Website for commercial or professional purposes;

- not modify, adapt, translate or reverse engineer any part of the Website;

- not use robots, spiders, site search/retrieval applications or other devices to retrieve or index any part of the Website or the content posted on the Website or to collect information about users for unauthorized purposes;

- not duplicate, reproduce, publish or disseminate by any means and in any form the Contents on the Website.

In addition, in order to guarantee the security of your data and Profile, by using the Website the User agrees to:

- store and keep its Profile access password in a safe place and under your direct control;

- not assign, transfer, share and/or disclose its Profile access password to third parties;

- not assign or transfer its Profile to third parties;

- keep its account and password confidential and monitor access to its computer and mobile devices;

- take all necessary precautions to ensure that its password remains secure and confidential.

In any case, if User encounters any abnormal activity in connection with its Profile, he/she should notify Aerenica immediately.

 

ART. 5- INTELLECTUAL PROPERTY RIGHTS

"Aerenica" and the logos and trademarks used on the Website are names and/or distinctive signs of which Aerenica S.r.l. is the exclusive owner and/or licensee and over which it has exclusive rights of economic exploitation.

The Website, Contents and Products are the exclusive property of Aerenica and are protected by copyright and IP rights laws. Moreover, Aerenica is the owner and/or licensee of all intellectual property rights - including but not limited to rights relating to designs, utility models, trademarks, know-how, technical specifications - relating to and connected with the Products on the Website.

Each Content and Product on the Website is the result of an investment of economic and intellectual resources that has enabled Aerenica to develop innovative Contents and Products and to distinguish itself from its competitors.

Aerenica therefore informs the User that any activity (such as, but not limited to, duplication, total and/or partial reproduction, publication or dissemination by any means and in all forms) concerning the Contents of the Website and/or part of the Contents, with the exception of personal use within the limits set forth in these T&Cs, is prohibited.

So-called deep hypertext links (or deep links) or using so-called framing techniques designed to prevent recognition of (or disguise the) true authorship of the Content are also prohibited.

It is expressly prohibited to use any part of the Website and its Contents for directly or indirectly professional, commercial and/or advertising activities of any kind.

The Customer undertakes not to perform, directly and/or indirectly, any act incompatible with the ownership of the aforementioned intellectual property rights referable to the Products and, in particular, the Customer shall refrain from using, reproducing in any form names and/or distinctive signs and logos present on the Website, as well as from registering similar and/or confusable with the trademarks used by the Seller and to produce and/or market Products or parts thereof in violation of the rights of the Seller and any assignor.

 

ART. 6- PROFILE

The Registered User shall have the right to use his/her Profile, under a temporary, non-transferable license for use by deed between living persons. No further use that is not expressly provided for in these T&Cs is permitted.

Aerenica may, without prior notice and need for authorization, in its sole discretion, suspend, inhibit access and/or impose restrictions on the Registered User's Profile if it deems it appropriate to protect the Registered User's interests or its own interests and, among others, in the following cases: repeated and/or serious violations of these Terms&Conditions for security reasons, to comply with legal obligations or in case of suspicion of illegal activities and for breach of confidentiality of correspondence.

The Registered User has the option to request deletion of his/her Profile at any time.

Aerenica has the right to suspend, temporarily or permanently, the Website and, therefore, in such a case the User will not have access to either the Website or his/her Profile.

 

ART. 7- AVAILABILITY OF PRODUCTS

Seller makes every reasonable effort to ensure that prices and information about the Products shown on the Website are accurate and up-to-date.

However, the inclusion of any Product on the Website does not imply, warrant or guarantee that the Products will be available at the time of the Order.

Seller shall have the right, at any time and without prior notice, to change the information about the Products set forth on the Website, including, without limitation, prices, descriptions, or availability of the Products.

Changes will have no effect on the price, availability, or description of any Product for which Customer has already received an Order Confirmation.

 

ART 8- CONTRACT

To purchase one or more Products available on the Website, the Customer must choose the Products, selecting color and size, and add them to the shopping cart.

If the Customer wishes to proceed with the purchase, the Customer may choose one of the following options:

If the Customer wishes to proceed with the purchase, he/she may choose one of the following options:

  • Quick Check-out with Google Pay, by clicking on the "GPay" button. By doing so, the Customer will be redirected to the Google Pay website where he/she can complete the payment, without registering with the Website. Once the payment is completed, the Customer will be redirected to the Website to enter the missing information needed to complete the order;

  • Quick Check-out with ApplePay by clicking on the relevant button. In doing so, the Customer, if they have the app installed or are using the Safari browser, will be redirected to the ApplePay site to complete the purchase via their saved credit card;

  • Quick Check-out with PayPal by clicking on the relevant button. This will redirect the Customer to the PayPal site where he/she will have to enter the email address and cell phone number linked to his/her PayPal account and complete the payment with PayPal;

  • Check-out with Shop Pay by clicking on the "shop" button. The Customer can create an account or log into their Shop Pay account to check-out faster and pay with Shop Pay.

  • Check-out from the Web Site, upon entering contact information (e-mail or phone number), delivery information (first name, last name, address), shipping method, and payment method (credit card), by clicking the "Pay Now" button;

  • Check-out from the Website by logging in to the Customer's personal account and clicking the "Pay Now" button. In this case, the Customer declares that he/she is responsible for the confidentiality of his/her password, as well as for restricting access to passwords and accounts, and accepts responsibility for all purchases and activities that will be performed with his/her account.

Before placing the Order, the Customer is required to carefully read and accept the contents of these T&Cs, as well as carefully read the information under Art. 13 of the GDPR on the processing of personal data. By accepting these T&Cs, the Customer declares that he/she is a Consumer and has reached the age of majority (18 years).

Finally, by completing the payment, the Customer will forward the Order to the Seller.

Before completing the Order, the Customer may change the type and quantity of the Products and is required to verify the correctness of the data entered and correct and/or modify the data according to the instructions indicated.

The placing of the Order implies the Customer's obligation to pay and no further changes will be allowed.

Each Order is subject to availability and acceptance by Seller who may, at any time and at its sole discretion, refuse to accept the Order. This may occur, for example, in the following cases:

- the Customer has provided (i) incorrect information (e.g., insufficient or incorrect payment details, incorrect billing information), (ii) an incorrect or incomplete shipping address, and (iii) false information;

- error on the Website with respect to the Products that are the subject of the Order (e.g., error in the price or description of the Products);

- unavailability of the Products that are the subject of the Order;

- in Seller's sole discretion, the total amount of the transaction and/or the number of Products covered by the Order appears to be excessively large for purchase by a Customer who is a Consumer;

- the Seller believes that the Customer has not reached the age of majority (18 years) and has not the capacity to act.

In the aforementioned cases, the Seller will contact the Customer at the e-mail address or telephone number provided as soon as possible.

The Seller reserves itself the right to reject Order proposals from a Customer with whom a dispute and/or dispute regarding a previous Order is pending or has previously occurred. This also applies to all cases in which the Seller deems the Customer unsuitable, including but not limited to the case of previous violations of these T&Cs or for any other reason, especially if the Customer has been involved in fraudulent activities of any kind.

At the e-mail address provided in the purchase phase, the Customer will receive the Order Confirmation and the Contract for the purchase and sale of the Products will be considered executed.

After receiving the Order Confirmation, the Customer, if he/she realizes that he/she has provided incorrect information about the billing and/or shipping information, may still contact the Seller at the e-mail address support@aerenica.com requesting the rectification of the same. The Seller, while not assuming any obligation or guarantee on the rectification, shall, if the processing status of the Order permits, make every effort to modify the Order.

The Seller will process each apparently correct Order proposal. Any error in the filling of data is the sole responsibility of the Customer, consequently, the Seller assumes no obligation to rectify or resolve misunderstandings resulting from the Customer's error and will not incur any costs for this reason.

In the case of Order proposals that immediately appeared incorrect, the Seller, before processing the Order proposal, may contact the Customer at the e-mail address provided by the Customer and ask for clarification. If the Customer does not provide feedback within and not later than 5 (five) working days from the day on which the Customer transmitted the Order proposal, the Seller will inform the Customer by e-mail that the Contract is not concluded and that the Order proposal will not be followed up specifying the reasons. In this case, any amount already committed to the chosen means of payment will be disengaged.

If the Customer does not receive the Order Confirmation within 48 (forty-eight) hours of the Order, the Customer is requested to contact the Seller at support@aerenica.com before attempting to place another Order for the same Products.

The Customer may request the issuance of an invoice by writing to the e-mail address support@aerenica.com.

 

ART. 9- PRICES 6 PAYMENTS

The prices of the Products are shown on the Website and will be confirmed on the Order check-out page and in the Order Confirmation.

Prices are inclusive of VAT, unless otherwise indicated. Any other fees and taxes, where applicable, are not included in the price and will be calculated according to the value of the Order and the shipping destination.

Shipping costs will be shown on the Order check-out page.

The Seller reserves the right to change the price of the Products at any time, but in any case, prior to sending the Order Confirmation.

Payment can be made by any of the methods listed in the "Payment Methods" section on the Web Site.

Credit Card Payments.

Major credit and prepaid cards are accepted. Payment by credit cards will be made at no additional charge.

In the event that the amount cannot be charged, the Order Proposal will be automatically cancelled.

It should be noted that the Seller is not able to fully know the Customer's credit card information, which is handled directly by the third party administering the payment. For this reason, the Seller will not be aware of such data, nor will it retain them and will only have access to the partial information that the Customer decides to save (e.g. type of card, expiration date of the card, cardholder), insufficient to identify the card, but useful to the Customer in case of subsequent purchases.

Therefore, under no circumstances can the Seller be held liable for fraudulent use of credit and prepaid cards by third parties.

Payments with Google Pay

The Customer can choose this payment method if they have installed the Google Pay application and selected the Google Pay option.

If the Customer selects the Google Pay option, a popup window will appear where the Customer will enter the shipping and billing address, then the Customer will select the preferred card linked to their Google Pay account.

Next, the Customer must click on the "Proceed" button and authenticate with fingerprint to validate the payment.

If the payment is made via Google Pay, the total amount due will be charged to the Customer by Google Pay. If the right of withdrawal is exercised, the refund will be credited to the same Google Pay account that the Customer used for the original purchase.

The time required to credit the payment instrument linked to that account depends solely on Google and the banking system. Once the crediting order has been activated in favor of such account, Seller cannot be held responsible for any delay or omission in crediting the refund. For disputes of this nature, you should contact Google directly.

Payments with Apple Pay

The Customer can choose this payment method if he/she has installed the Apple Pay application, activated the Apple Pay option, and is using the Safari browser.

If the Customer selects the Apple Pay option, a popup window will appear where he/she must enter the shipping and billing address, then he/she must select the preferred card linked to his/her account and click the "Proceed" button. The Customer then needs to authenticate with Face ID or fingerprint to validate the payment.

If the payment is made through Apple Pay, the total amount due will be charged to the Customer by Apple Pay.

In case of a refund, this will be credited to the same Apple Pay account that the Customer has for the payment. The time required to credit the payment instrument linked to that account depends solely on Apple Pay and the banking system.

Once the crediting order has been activated in favor of such an account, Aerenica cannot be held responsible for any delay or omission in crediting the refund. For disputes of this nature, you should contact Apple directly.

Payments by PayPal

If the Customer chooses PayPal as payment method, he/she will be redirected to the website www.paypal.com where payment for the Products will be made following the procedure provided and regulated by PayPal and its terms and conditions.

The data entered on the PayPal website will be handled directly by PayPal and will not be sent to or shared with Aerenica, except for the data required to finalize the Delivery of the Products if you have selected the quick check-out option with PayPal. Accordingly, Aerenica will not be aware of or record in any way the details of the credit card linked to the PayPal account or any other payment instrument linked to that account.

The Customer's PayPal account will be blocked an amount equal to the total value of the Order and, once PayPal has authorized the "blocked" amount, the total amount of the Order will be debited from the Customer's PayPal account when the Products are shipped.

Aerenica will not accept the Customer's Order or supply the Products until PayPal has authorized the use of the Customer's PayPal account to pay for the Products.

Aerenica will notify Customer if it does not receive such authorization and reserves the right to verify the identity of the PayPal account holder by requesting appropriate documentation. Once PayPal has authorized the "blocking" of the amount on the Customer's PayPal account, it is possible that if the PayPal account is charged less than the "blocked" total, the balance may not be immediately fully available for reasons beyond Aerenica's control (for example, delays by PayPal in removing the "block" from your PayPal account).

Payments with Shop Pay

If the Customer chooses Shop Pay as their check-out method, they will need to create a Shop Pay account and enter their credit card and shipping and billing information or log into their account if already registered. If the Customer uses the Shop app, the Customer will be prompted to verify the purchase through the app. However, if the Customer uses only Shop Pay, they can verify the purchase using their Shop access key or a unique six-digit code received via SMS or email.

Following the first verification, the Customer can perform subsequent check-outs without the need for confirmation via Shop app or SMS. During check-out, the Customer will be redirected to Shop Pay for verification of their data, before returning to check-out to complete the purchase.

The Customer's shipping and billing information is stored on Shopify servers and, therefore, Aerenica will not be aware of or record in any way the credit card details linked to the Shop Pay account.

 

ART. 10- PRODUCT SHIPMENT AND DELIVERY

The Products may be delivered anywhere in the world.

The Products will be delivered by the carrier identified by Seller.

Seller will make every reasonable effort to deliver the Products within the number of days specified in the Order Confirmation. However, the written delivery date is only an estimate and Seller shall not be liable for any loss or damage suffered by Customer due to delay in delivery.

The Customer will receive a shipping confirmation e-mail from the shipping company indicating the expected delivery date of the Products and the ability to track the shipment.

Delivery is by courier during normal business hours. Please note that the courier contracted by Seller cannot deliver packages without receiving a signature and/or payment of customs duties, if applicable.

Upon receipt of the Products, it will be the Customer's responsibility to check the integrity of the package and the presence of any damage to the package that is immediately apparent (for example: wet box, damaged box, etc.).

In case of anomalies, the Customer will be required to detect them immediately, having them noted by the courier and refusing the Delivery. Otherwise, the Customer will forfeit the possibility of asserting his/her rights in this regard. By signing the delivery receipt/proof of delivery, the Customer acknowledges that the Products are correct.

From Delivery, the Customer becomes the owner and responsible for the Products.

Upon Delivery, the Customer shall verify that the Products conform to the Order and are free from defects and/or faults.

By this instrument, the Customer waives its right to a refund if it fails to comply with the above provisions.

 

ART. 11- SPECIAL RULES FOR BESPOKE PRODUCTS

These Special Rules for Bespoke Products, together with the T&Cs, apply to Customer in the case of purchase of Bespoke Products. In the event of any conflict between the T&Cs and these Special Rules, Special Rules shall prevail.

No returns or exchanges will be accepted for Bespoke Products unless the Bespoke Products are damaged or defective, according to paragraph 15. However, the Customer may cancel the Order for Bespoke Products within 3 (three) days of placing it on the Website. In such case, the Seller will refund the purchase in full.

Bespoke Products may be delivered within the time frame indicated on the Web Site. Delivery terms are indicative only and may vary depending on the customization required. Generally, Bespoke Products are shipped separately from orders for other Products (Ready-to-Wear Products).

The payment methods accepted for the service of Bespoke Products are the same as those indicated in paragraph 9.

 

ART. 12- PRODUCT REPLACEMENT EXCLUSIONS AND RIGHT OF WITHDRAWAL

The Product Replacement procedure set forth in these T&Cs applies only to Ready-to-Wear Products purchased on the Seller's Website. The Seller will not accept returns and/or replacements of Products purchased on other Websites or from stores.

The Product Replacement and Right of Withdrawal procedures set forth in these T&Cs do not apply to Bespoke Products.

 

ART. 13- REPLACEMENT OF PRODUCTS

The Customer may change the size and color of the Ready-to-Wear Products purchased on the Website within 14 (fourteen) days from the day of Delivery of the Products. The request to exchange the Products may be sent to the e-mail address support@aerenica.com.

Each Ready-to-Wear Product may be replaced or returned only once.

The Ready-to-Wear Products subject to replacement must not have been used, worn, washed, soiled or damaged, must not show signs of use, and must have all tags and labels and any packaging intact.

The Ready-to-Wear Products subject to replacement must be returned packaged exactly as they were shipped, complete with all accessories and labels.

The Seller at its sole discretion may authorize or deny the replacement of the Ready-to-Wear Products. In case of acceptance, it will provide the Customer with the directions to be followed in sending the Ready-to-Wear Product to be replaced.

Unless otherwise agreed, the cost of returning the Products, including customs duties, to be replaced will be borne by the Customer.

 

ART. 14- RIGHT OF WITHDRAWAL

The Customer shall have the right to withdraw from the Contract, without penalty and without specifying the reason, by returning to the Seller all or part of the Ready-to-Wear Products purchased on the Website. The Customer must notify the Seller in writing of the intention to exercise the right of withdrawal within the period of 14 (fourteen) days from the day of Delivery of the Ready-to-Wear Products. The notice may be sent to the e-mail address support@aerenica.com.

Within 14 (fourteen) days from the date on which the Customer has communicated its decision to withdraw from the Contract, it must return the Prêt-à-porter Products duly packaged by delivery to the courier chosen by the Customer.

Returned Prêt-à-porter Products must not have been used, worn, washed, soiled or damaged, must bear no signs of use and must have all tags and labels.

Returned Ready-to-Wear Products must be returned packaged exactly as they were shipped, complete with all accessories and labels.

It should be noted that if the right of withdrawal is exercised, the Customer will be responsible for the cost of returning the returned Products to the Seller, including customs duties and import taxes.

Subject to possible delays of a technical nature beyond the Seller's control and not attributable to it (e.G. malfunction of the payment circuit), the Seller will refund to the Customer the price of the returned Prêt-à-porter Products no later than 14 (fourteen) days from the day on which the Seller was informed of the decision to exercise the right of withdrawal, provided that the Seller has already received the return of the Products or that the Customer has provided it with proof that it has already shipped the Products by being able, until then, to withhold the refund. Any customs duties and import taxes shall be borne exclusively by the Customer.

The Seller will use the same means of payment used for the purchase of the Ready-to-Wear Products for the re-credit.

In the event that the right of withdrawal is exercised without complying with the procedures set forth in paragraph 7, the Customer shall not be entitled to any refund. Within 10 (ten) days from the sending of the email notifying the Customer of the non-acceptance of the return and the reasons therefor, responding to the same e-mail, the Customer may choose to re-obtain, at his/her expense, the returned Products. Otherwise, the Seller may legitimately retain the returned Products, in addition to the amounts already paid for the relevant purchase.

 

ART. 15- LEGAL WARRANTY FOR NON-CONFORMING PRODUCTS

The Seller shall be liable for any defect in the Products and for the non-conformity of the Products with the Order placed, existing at the time of delivery of the goods.

The duration of the warranty is 2 (two) years from the time of Delivery of the Product. This warranty is valid under the following conditions:

- manifestation of the defect within 2 (two) years from the date of delivery of the Products;

- presentation to the Seller by the Customer of commercial document/invoice of purchase and proof of delivery.

The Customer may contact the Seller at the e-mail address support@aerenica.com, reporting the defect and attaching proof thereof. Such communication must be made promptly upon discovery of the defect and/or non-conformity of the Product.

The warranty applies only if the Products have been used correctly, in compliance with their function and in accordance with the instructions for use and washing.

In the event that the lack of conformity of the purchased Products has been ascertained by the Seller, the Customer shall have the right to obtain, without additional expense, alternatively:

- the repair of the Products;

- the replacement of the non-conforming Products with others of equivalent amount;

- the refund of the amount paid for the purchase of the Products. The return will be made through the same means used by the Customer for the initial purchase.

All costs of returning Products acknowledged to be defective will be borne by Seller.

If the Seller reasonably believes that the returned Products are not defective/damaged and have no quality problems or have been damaged due to misuse, the Customer shall not be entitled to repair and/or replacement of the Products and/or refund.

 

ART. 16- RESALE

Resale, rental, or transfer for commercial or professional purposes of the Products purchased on the Website is strictly prohibited.

The Seller reserves the right to refuse the Order if it suspects that the Customer intends to resell the Products.

 

ART. 17- LINKS TO THIRD PARTY WEBSITES

The Website may contain links to third party websites.

Aerenica disclaims any liability for actions and/or omissions arising from the use of the information and content of such third party websites, and does not guarantee the completeness and accuracy of the content and information provided by them.

 

ART. 18- CONTACTS AND CUSTOMER SERVICE

For all inquiries regarding the Products and these T&Cs, as well as for all complaints, the Customer may contact the Seller as indicated below.

Customer service is available in Italian and English from Monday to Friday from 9.00 a.m. to 6.00 p.m. CET, excluding holidays.

The Seller will provide a timely response without undue delay, putting its best efforts to encounter the Customer within 5 (five) business days.

 

ART. 19- CORRESPONDENCE WITH AERENICA

Correspondence with Aerenica is intended to be confidential and intended only for the User. Therefore, it may not be disseminated in any form. In the event of unauthorized dissemination and/or communication, Aerenica may take all appropriate steps to protect its interests, including suspension or deletion of the Profile for violation of these T&Cs and action in criminal court for the offenses referred to in Articles 616 (violation, misappropriation and suppression of correspondence) and 618 (disclosure of the contents of correspondence) of the Italian Criminal Code.

 

ART. 20- PERSONAL DATA PROCESSING

The processing of personal data will be carried out by Aerenica in full compliance with current European and Italian legislation on the protection of personal data (EU Reg. no. 679/2016 c.d. "GDPR" - and Italian Legislative Decree no. 196/2003 c.d. "Privacy Code", in the parts not expressly repealed by Legislative Decree no. 101/2018), as indicated in our Privacy Policy, Cookie Policy and notices, which we invite you to carefully read.

 

ART. 21- GOVERNING LAW AND PLACE OF JURISDICTION

These T&Cs and the Contracts concluded between the Customer and the Seller are subject exclusively to Italian law.

Any dispute regarding the interpretation and execution of the Contract concluded through the Website and any other dispute for any reason connected to the same shall be devolved to the jurisdiction of the Court of the place where the Consumer is domiciled or resident or, at the choice of the Consumer, of the Court of Turin.

Pursuant to Article 19 of the Italian Legislative Decree no. 70/2003, the Parties may refer to out-of-court dispute resolution bodies that also operate by telematic means. It is also possible to turn to the European Union's ODR platform that can be reached at the following link ec.europa.eu/consumers/odr/.
