NEWSLETTER - PRIVACY POLICY

pursuant to Article 13 of the European Regulation No. 2016/679 (“GDPR”)

1. Data controller

AERENICA s.r.l. (VAT no. 12956290014), with registered office in Corso Massimo D’Azeglio 60/H, Torino (TO) - Italy, certified e-mail address: aerenicasrl@pec.cgn.it , e-mail address: privacy@aerenica.com (“Aerenica”).

1. Personal data

Personal data means any information relating to you. 

Within the purposes referred to in point 3), Aerenica shall process the following personal data: e-mail address (“Data”).

1. Purposes of the processing

Your Data will be processed for the following purposes: 

1. the subscription to Aerenica's newsletter in order to send you periodic communications containing news and information regarding the products and services of the same and of its commercial partners, as well as the activities and initiatives, commercial and non-commercial, organized by the same or in which the same participates and the participation in market research and activities to survey your degree of satisfaction, regarding the contents and products of Aerenica and its commercial partners;
2. the communication of your Data to third parties (companies belonging to the fashion&luxury, beauty, skin care, design, music&entertainment, media, publishing, cooking, food, catering sectors) for the purpose of sending promotional and commercial communications by them.

1. Legal basis of the processing

The processing of your Data for the purposes referred to in point 3) above is your given consent (Art. 6, lett. a) GDPR).

1. Methods of the processing

The processing of your Data will be through IT tools with the implementation of appropriate security measures and in compliance with the legal provisions on the processing of personal data.

The processing of your Data will be managed under the instructions of Aerenica by trained personnel in order to ensure the appropriate level of security and confidentiality, as well as in order to avoid risks of loss, destruction and unauthorized access to or disclosure of personal data.

Communication and disclosure of Data 

Your Data shall not be disclosed.

For the purposes referred to in point 3) above, your Data may be communicated to:

• subjects legitimated by law or regulation, such as the competent public authorities and the judicial authority;
• subjects specifically appointed as Data processors (individuals or entities that process data on the documented instructions of Aerenica such as, for example, the person in charge of the management and maintenance of the IT systems, the company in charge of the website management, as well as the company that manages the automation platform of the e-mail marketing service).

An updated list of Data processors can be requested from Aerenica by e-mail.

For the purpose referred to in point 3) lett. b), your Data may be communicated to companies belonging to the economic and product categories referred to in the same point. More information can be requested from Aerenica by e-mail.

1. Data retention

For the purposes referred to in point 3), subject to the possibility of revocation of consent as indicated in point 8) below, your Data will be retained for a period of 24 months after your subscription to the newsletter and in any case until you revoke your consent, including by unsubscribing, in the manner indicated in point 8) below.

Your Data may be retained for a longer period in compliance with any legal retention obligations, as well as for the exercise of Aerenica’s right of defense.

1. Rights of the data subject

In compliance with the provisions of the GDPR and of the Legislative Decree no. 196/2003 (Part I - Title I - Chapter III), with reference to your Data you shall have the following rights:

• right of access to your Data in the cases provided for under the law (Art. 15 GDPR);
• right to rectification of your inaccurate Data and to have your incomplete Data completed (Art. 16 GDPR);
• right to erase of your Data, where one of the grounds provided in Art. 17 GDPR applies (e.g. Data are no longer necessary in relation to the purposes they are processed or Data have been unlawfully processed) (Art. 17 GDPR);
• right to restriction of processing if one of the reasons provided for under the law occurs (e.g. the accuracy of the Data is contested and their accuracy must be verified) (Art. 18 GDPR);
• right to Data portability that means the right to receive Data in a structured, commonly used and machine-readable format and to transmit those Data to another controller (Art. 20 GDPR);
• right to object, on grounds relating to your particular situation (Art. 21 GDPR).

You shall exercise the above-mentioned rights by sending an e-mail or a certified e-mail or a registered letter to Aerenica at the addresses indicated in point 1) above. 

In connection with your subscription to the newsletter, you may revoke your consent at any time without affecting the lawfulness of the processing carried out prior to the revocation of consent by clicking on the button at the bottom of each newsletter.

For the purpose referred to in point 3) lett. b) above, you have the right to withdraw the consent provided for the processing of your Data at any time, without affecting the lawfulness of processing based on consent before its withdrawal, by sending an e-mail to the e-mail address indicated in point 1) above.

1. Lodging a compliant

If you believe that the processing of your Data infringes the provisions of the GDPR, you have the right to lodge a complaint with the Italian supervisor authority (Garante per la protezione dei dati personali) in accordance with the provisions of Art. 77 of the GDPR.

1. Nature of providing Data

In relation to the purpose referred to in point 3) lett. a), the provision of your Data is optional in nature, but failure to provide even part of your Data will result in the objective impossibility of proceeding with your subscription to the newsletter. 

In relation to the purpose referred to in point 3) lett. b), the provision of your Data is optional in nature.

1. Transfers of Data to a third country

Your Data are stored at the Aerenica’s headquarter and on servers located in the European Union. For the purpose of sending the newsletter, your Data is transferred to third countries; the company providing this service has provided adequate safeguards in accordance with Art. 46 of the GDPR (standard contractual clauses approved by the European Commission).
